Overview

ROLE AT A GLANCE:

Within their assigned countries of responsibility, this individual will provide technical tax advice and tax support with respect to income and non-income tax matters. The individual will anticipate business needs and develop innovative alternatives to meet those needs. The individual will continually review the tax position of Herbalife within their assigned countries of responsibility taking account of GAAP, local statutory accounting and tax perspectives.

HOW YOU'LL MAKE AN IMPACT:

Form high level strategic partnerships with country management and regional management groups to facilitate the exchange of business information and favorably impact Herbalife's tax position.
Review and analyze complex business transactions; discern tax sensitive issues; conduct technical research to determine the most advantageous tax position available, identify alternatives and communicate results in a timely and comprehensive manner.
Review, analyze and provide advice with respect to significant income and non-income tax audits. Where appropriate, interact and conduct negotiations with foreign tax authorities.
Manage outside tax counsel and other tax advisors with respect to planning, audit and other projects.
Manage and conduct defense in Customs-related audits and litigation, in cooperation with Global Trade & Traffic Dept.
Work with the Director of Transfer Pricing to ensure all transfer pricing requirements and related documentation requirements are satisfied.
Prepare, review and/or manage tax ruling requests, tax programs, structures and APA agreements as appropriate.
Interact with and provide advice to country and regional corporate groups at all levels regarding specific technical foreign tax matters.
Analyze book tax, local tax and US Tax consequences of transactions.
Oversee new country opening process.
Coordinate with the Tax Accounting Department to provide all information relevant to preparation of tax items in income statement and balance sheet. Assist tax accounting as needed with support or information required for audit.
Manage and review technical advice and opinion letters of outside tax counsel.
Review and analyze foreign court decisions, legislation and administrative regulations to advise management as to the impact on the company. Recommend and implement actions to mitigate or benefit from changes.
Prepare and/or review all intercompany agreements and third party agreements.
Communicate regularly with the Tax Accounting Department and tax counsel.

LEADERSHIP AND SUPERVISORY RESPONSIBILITIES:

Supervises China Tax Dept (3 heads) and Regional Tax Manager (1head). Manages advisors and projects.

Qualifications

QUALIFICATIONS FOR SUCCESS:

Education

8+ years international tax planning including planning under the laws of foreign countries
10+ years in a major corporation, law firm and/or accounting firm
Knowledge of FIN 48 and FAS 5
Application of APB 23
Foreign audit management experience
Experience managing outside counsel

Experience

Graduate degree in Tax and Accounting, or equivalent
Some level of education/experience in US Tax rules/system
